Agreement to Terms

By accessing our website or using our services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services. SFM Springfield Masonry reserves the right to modify these terms at any time. Your continued use of our services after changes are posted constitutes acceptance of those changes.

SFM Springfield Masonry provides professional masonry services including brick repair, chimney work, tuckpointing, retaining walls, patios, and related services. All services are subject to availability and scheduling. We reserve the right to refuse service to anyone for any lawful reason. Service descriptions on our website are general in nature, and specific project details will be outlined in individual contracts or estimates.

Estimates and Pricing

All estimates provided are good faith approximations based on the information available at the time. Final pricing may vary if project conditions differ from initial assessments. We provide detailed written estimates before beginning work. Changes to project scope require written approval and may result in adjusted pricing. Payment terms will be specified in individual contracts. We accept various payment methods, and payment is due according to the agreed-upon schedule.

Project Completion and Delays

We make every effort to complete projects within estimated timeframes. However, completion dates may be affected by weather conditions, material availability, permit delays, or unforeseen site conditions. We are not liable for delays beyond our reasonable control. We will communicate any significant delays as soon as they become known. You agree to provide reasonable access to your property for the duration of the project.

Warranties and Guarantees

We stand behind our workmanship and offer warranties as specified in individual contracts. Warranty terms vary depending on the type of work performed and materials used. Our warranties cover defects in workmanship but do not cover damage from improper maintenance, natural disasters, or normal wear and tear. Material manufacturers may provide separate warranties. Any warranty claims must be submitted in writing with reasonable detail about the alleged defect.

Limitation of Liability

To the maximum extent permitted by law, SFM Springfield Masonry shall not be liable for any indirect, incidental, special, or consequential damages arising from our services. Our total liability for any claim shall not exceed the amount paid for the specific services in question. We maintain appropriate insurance coverage as required by law. Nothing in these terms limits liability that cannot be legally limited.

Property Damage and Safety

We take precautions to protect your property during work, but some disruption is unavoidable in construction projects. You agree to remove or protect valuable items in work areas. We are not responsible for damage to underground utilities not properly marked or disclosed. You are responsible for ensuring pets and children stay clear of work areas for their safety. We follow all applicable safety regulations and expect cooperation in maintaining a safe work environment.

Permits and Compliance

When required, we will obtain necessary permits for masonry work. Permit costs are typically included in project estimates unless otherwise specified. You are responsible for ensuring project compliance with any homeowners association rules or deed restrictions. We make reasonable efforts to comply with local building codes, but you acknowledge that code interpretations may vary. Final inspection and approval are the responsibility of local building authorities.

Intellectual Property

All content on our website, including text, images, logos, and designs, is the property of SFM Springfield Masonry or used with permission. You may not reproduce, distribute, or use our content without written permission. Project photos may be used for our marketing purposes unless you specifically request otherwise in writing. Custom designs created for your project remain our intellectual property unless otherwise agreed in writing.

Dispute Resolution

We encourage direct communication to resolve any concerns about our services. If a dispute arises, we agree to first attempt resolution through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Greene County, Missouri, under the rules of the American Arbitration Association. Each party bears their own costs unless the arbitrator determines otherwise. This agreement does not prevent either party from seeking injunctive relief in court when necessary.

Cancellation and Refunds

You may cancel services before work begins, subject to cancellation fees for work already performed, materials ordered, or scheduling commitments made. Once work has started, cancellation terms will be based on work completed and materials used. Deposits are non-refundable once materials have been ordered or crew scheduling has occurred. We reserve the right to cancel or suspend services if payment terms are not met or if site conditions prevent safe work.

Governing Law

These Terms of Service are governed by the laws of the State of Missouri without regard to conflict of law principles. Any legal action must be brought in the courts of Greene County, Missouri. If any provision of these terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
